Irrigation Department not "factory", Chapter VB of Industrial Disputes Act on layoff, retrenchment will not apply: Supreme Court

The Court ruled that the predominant activity of Irrigation Department is not "manufacturing" under Section 2(k) of Factories Act and it is, therefore, not a factory under the Act.

An establishment cannot be termed as a 'factory' within the meaning of section 2(m) of the Factories Act unless it is carrying on a manufacturing process as defined in Section 2(k) of the Factories Act, the Supreme Court held on Wednesday (State of Madhya Pradesh v. Somdutt Sharma).
