After listing an interlocutory application in a jiffy, the Supreme Court today directed the Kerala police to share details of the investigation of the Hadiya case with the National Investigation Agency (NIA)..A Bench of Chief Justice JS Khehar and Justice DY Chandrachud turned down the plea by the counsel for Hadiya’s husband to hear the matter on August 16, when the main case has been listed for hearing..“Please wait till August 16, the matter has been investigated by Kerala police”, submitted advocate Haris Beeran, appearing for the petitioner, Shafin Jahan..Justice Chandrachud said,.“We are not ordering them to investigate, we are only giving them records so that they can decide whether it is an isolated issue in a pocket or something more wide.”.“Why are Your Lordships doubting the Kerala police? There is an investigation by Kerala police”, said Beeran..CJI Khehar replied,.“We are not doubting the Kerala police. We are not asking NIA to investigate. We are only sharing details of the investigation with them. It is unfair of you to oppose it. Are you doubting the NIA?”.The Court then proceeded to order the Kerala police to hand over the records of the investigation to NIA. The Kerala police has also been asked to render all assistance and co-operation to NIA..Counsel for petitioner also highlighted the use of the term ‘Love Jihad’ to describe the case..“‘Love jihad’ in common parlance is some kind of love trap in which girls are trapped. This is a simple case, which has been blown out of proportion.”.Justice Chandrachud, however, said that the Court has not used any such term and those are catch phrases used by the media. He remarked,.“We are not going by such catch phrases used on social media etc.”.The matter will now come up for hearing on October 16..Interestingly, the interlocutory application which was heard today was mentioned by Additional Solicitor General Maninder Singh at 10.30 AM.
