A lawyer practicing in the district courts of Delhi, Suhas Joshi, has filed a petition against online retailer Snapdeal and Adult wellness products company Ohmysecrets. Their crime? Selling products like anal lubes, anal sprays, and massagers. .Joshi has argued that the sale of these products amounts to the abetment of acts prohibited under Section 377 of the IPC, and for violation of 292, 292A, 293, 294 of IPC and Section 67 of the Information Technology Act, 2000..Suhas, who is also an Advocate on Record in the Supreme Court, argues that products such as lubes promote anal sex, an act that is prohibited by Section 377 of the IPC. This particular provision of law, which criminalises voluntary acts against “the order of nature, has been declared constitutional valid by the Supreme Court..As per the petition,.“…the said depictions/contents/offers in the respective websites of both the accused is strongly suggestive of lascivious desires appealing to prurient interests or its effects, etc on Indian citizenry in general and invites invocation of Sections 292, 292A, 293, 294 (of offences affecting the public health, safety, convenience, decency and morals) of IPC as also of Section 67 of IT Act, 2000, being in the teeth thereof.That it is further stated that both the accused also stand in violation of Section 377 (of unnatural offences) of IPC together read with Sections 107, 108, 109 and 116 (of abetment) of IPC.”.Suhas has also stated in his petition that it is not practically possible for him to pin point all the market-players and their activities while contending,.“That there are a plethora of e-tailers operating in the dubious business of Sexual Wellness nay Adult Products of lascivious and enticing nature, thereby, inspiring prurient interests in the minds of Indian citizens in general…”.On the above grounds, he has prayed for direction to the concerned police station to initiate proceedings against the respondents and register FIR against for offences under the IPC and IT Act..The matter is next listed for March 21, 2015 before Metropolitan Magistrate Richa Gusain Solanki, Tis Hazri Courts for filing of Status Report by SHO of Sabzi Mandi police station..Image By Terence Ong (Own work) [GFDL, CC-BY-SA-3.0 or CC BY-SA 2.5], via Wikimedia Commons
