Justice Deepak Gupta yesterday lamented that the Code of Criminal Procedure (CrPC) is not being adhered to by trial courts leading to procedural delays and difficulties. This was leading to witnesses being forced to come to court fifteen or sixteen times, he said..The remarks were made during the hearing of the case concerning prison reforms..“Witnesses are many times tired of coming to court, they are made to come to court 15 or 16 times. If we follow CrPC, there would be no problems. But practice at the ground level is different”, remarked Justice Gupta..This case relating to prison reforms came to be heard by the Supreme Court after two Supreme Court judges, Justices (retd.) AK Goel and UU Lalit were invited by the Haryana Legal Services Authority for an event at Faridabad. During the jail visit, the two judges had observed umpteen deficiencies in prisons and had submitted a report regarding the same..In their report, Justices Goel and Lalit had noted that these issues arise not just in Faridabad, but in jails and observations homes across the country. With a view to addressing these issues, the judges had made suggestions for improving the conditions in jails..What the two judges witnessed in the Faridabad Jail and Observation Home led to Supreme Court taking upon itself the responsibility to improve conditions and infrastructure in jails..A report on the issue was submitted to the Supreme Court by the District Judge, Faridabad..The Court had then sought the assistance of Attorney General KK Venugopal and also appointed Advocate Gaurav Agrawal as amicus curiae in the matter..The Amicus submitted a report yesterday whereupon the court proceeded to pass an order.
