Transfer of Justice PV Sanjay Kumar as P&H HC judge: Telangana lawyers to go on week-long strikeSeptember 3 2019
The recent proposal of the Supreme Court Collegium to transfer Justice PV Sanjay Kumar of the Telangana High Court as a judge of the Punjab and Haryana High Court has sparked off a protests amongst members of the Telangana Bar. As a mark of protest, a resolution has been passed for the abstention of lawyers from appearing in courts throughout Telangana this week.
The resolution was passed during an extraordinary General Body meeting of the Telangana High Court Advocates' Association (THCAA) this afternoon. A delegation comprising the Association's Executive Committee and Senior Judges is also expected to represent their grievance to the Chief Justice of India Ranjan Gogoi, the Collegium judges, Union Law Minister Ravi Shanker Prasad, President Ram Nath Kovind and the Telangana High Court Chief Justice.
The resolution has also called for a recall of the Collegium resolution proposing the transfer of Justice PV Sanjay Kumar as a judge of the Punjab & Haryana High Court.
The TNHAA has asserted that Justice Kumar, being a senior judge of the High Court, ought to have been elevated as a High Court Chief Justice instead. Justice Kumar is presently the senior-most judge of the Telangana High Court after Chief Justice RS Chauhan.
Today, Senior Advocates of the Telangana High Court also echoed the demand, terming the proposed transfer of Justice Kumar as punitive measure. The lawyers have noted that if the transfer goes through, Justice Kumar would become the 12th senior-most judge at the Punjab & Haryana High Court. Instead, the lawyers have called for the appointment of Justice Kumar as a High Court Chief Justice from the Telangana quota. A letter issued by the Senior Advocates in this regard states,
"The Senior Advocates are voicing their protest on the recommendation for the transfer of senior-most puisne Judge Hon’ble Sri Justice PV Sanjay Kumar as Judge of Punjab and Haryana High Court. The transfer is seemingly punitive.
We request that the said recommendation be kept in abeyance and be recalled. Steps must also be taken to appoint Hon’be Sri Justice PV Sanjay Kumar as Chief Justice of a High Court…"
Apart from protest over the transfer of Justice Kumar, the Telangana High Court Advocates' Association today also unanimously resolved to file a PIL in the Supreme Court for the framing of guidelines when it comes to appointment of Judges, elevation of Chief Justice of High Courts, elevation of judges to the Supreme Court and transfer of Judges.
