The Supreme Court today ordered status quo in the matter pertaining to Indian Hotels Company Limited’s (IHCL) license for the Taj Mansingh Hotel..A Bench of Justices Pinaki Ghose and UU Lalit issued notice to the New Delhi Municipal Corporation (NDMC) and posted the case for January next year..Senior Advocate Harish Salve appeared for Indian Hotels, while Additional Solicitor General Sanjay Jain appeared for NDMC..Last month, the Delhi High Court gave NDMC the nod to auction off the Taj Mansingh Hotel. IHCL was awarded a 33-year old lease which expired in 2011, after which several rounds of litigation took place. IHCL had argued that not only had they obtained the lease from NDMC, but they had also actively participated, partnered and invested along with the NDMC in the hotel..When the case came up for hearing today, Salve argued that the Indian Hotels should be offered the right of first refusal on a price discovery or otherwise..ASG Sanjay Jain argued that the agreement makes it clear that the appellants only have a right to seek renewal and that it is up to the NDMC to renew it or not..The Court said that it will hear the matter and issued notice, after ordering a status quo..The matter is now listed for hearing on January 2, 2017.
