Supreme Court holds minority schools to be exempt from RTE Act [Download judgment]

The Supreme Court today upheld the Constitutional validity of Articles 15(5) and 21A of the Constitution. It, however, held that the Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) in so far as it applies to minority schools, aided or unaided, is unconstitutional.

The judgment was delivered in a batch of fourteen petitions filed by charitable organisations that are running private schools in Karnataka
