Supreme Court clarifies its order on appointments to Tribunals [Read order]

The Supreme Court today issued clarifications with respect to its order passed on February 9 on appointments to tribunals..A Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud heard Attorney General KK Venugopal, Senior Counsel Siddharth Luthra and advocates Ajay Bansal and Arun Monga appearing on behalf of the petitioner/applicant..The court then issued the following clairifcations:.The appointment of the Chairpersons of the Tribunals shall be made by the Central Government in consultation with the Chief Justice of India;The Search-cum-Selection Committee for the appointment of Judicial Members of the Central Administrative Tribunal shall also proceed with the selection of Administrative Members;The tenure of the Chairperson and Judicial/Administrative/Expert/Technical Members of all the Tribunals shall be for a period of five years or the maximum age that was fixed/determined under the old Acts and Rules;The Committee that has been constituted for selection of the Members of the Central Government Industrial Tribunal shall proceed as per our previous order as it has already proceeded with its work..The Court also extended the tenure of Members including Chairperson, who are continuing in National Consumer Disputes Redressal Commission, from March 15 to May 31..On February 9, the Supreme Court had accepted the suggestions made by the Central Administrative Tribunal (CAT) Bar Association on appointments to various tribunals..By doing so, the Court had effectively stayed many provisions of the Rules framed under the Finance Act, 2017..Today’s order is a clarification with respect to those suggestions..Read the order below.
