The State of Commercial Laws Interpretation of Umbrella Clauses in International Investment Arbitration

White Industries Australia Limited v. Republic of India  (“White Industries”) has opened a pandoras box in India and India is today set for the “Investment Arbitration revolution”- a revolution which caught the western world by storm in the 1990’s and 2000’s. White Industries appears to be especially worrying because a foreign investor succeeded against the Indian Government before an international forum in a case where an effective remedy before an Indian Court was not available. Taking into account the number of foreign investors who do not obtain speedy justice in India, White Industries has set a dangerous precedent for foreign investors to follow. While Vodafone has already served the Indian Government a notice for investment treaty arbitration, parties such as Children Investment Fund also seem to be contemplating such action.
