SRGR Law Offices had filed an FIR against FoxMandal Partners on February 16, 2011 at 11pm at Noida’s Sector-20 Police Station alleging cheating, defrauding, and committing criminal breach of trust, impersonation, false information to police officers, misuse of electronic identity, criminal intimidation and trespassing. The police today visited the FoxMandal office pursuant to this FIR..SRGR has initiated this criminal complaint in response to the FIR filed by FoxMandal against SRGR partners on December 14, 2011 alleging cheating, defrauding, criminal breach of trust, impersonation and theft of vital data of FoxMandal..Lawyers Ravi Bishnoi, Saroj Kumar Jha, Rajan D Gupta and Akshat Pande had left FoxMandal in 2009 to start their own law firm ‘SRGR Law Offices’..SRGR has filed the FIR against Managing Partner Som Mandal and Partners Sangeeta Mandal and Dinabandhu Mandal and also against FoxMandal’s IT Manager Binod Kumar Singh..Speaking to Bar & Bench, Ravi Bishnoi said, “We have a very strong case against the accused..There is no room for persons with double standards in the legal profession,”.Bar & Bench has seen a copy of the FIR filed by SRGR. This FIR alleges that the criminal proceedings initiated by Som Mandal are hit by mala fide intent and are a deliberate attempt to put undue pressure on SRGR and coerce SRGR to withdraw the recovery suits filed by SRGR before the Delhi High Court..The FIR also alleges that Som Mandal has given the impression that the SRGR partners are still a part of FoxMandal and has even used the former partners email id’s to communicate with clients..The complaint furthers states that FoxMandal made false promises of increasing their salaries; promises which were never fulfilled..Perhaps one of the most serious allegations contained in the FIR is leveled against IT manager of FoxMandal Binod Kumar Singh. The FIR states that the said BK Singh, during the investigations at the SRGR office on December 14, 2011, had “implanted data” into SRGR computers and has also “caused changes” to SRGR’s data.Along with the abovementioned allegations, the FIR also alleges commission of the offences under sections 182, 406, 420, 425, 426, 409, 468, 471, 477-A, 506 of the Indian Penal Code (IPC) and sections 65, 66, 72, 85 of the Information Technology Act..The FIR further states that it is imperative that all servers and computer systems of Som Mandal and FoxMandal & Co. be immediately taken into custody under a magistrate and be thoroughly examined because there is “a genuine apprehension” that Som Mandal and others will cause deletion of data.Managing Partner Som Mandal has confirmed that SRGR has filed a FIR against him and his family members and one of his IT staff members..Speaking to Bar & Bench on this development, Mandal stated that , “They [SRGR] are nervous that the data theft case that we have filed against them is going full ahead and they will be arrested soon. Therefore, as a counter blast SRGR has filed a false and frivolous FIR….[the] law will catch up for what they have done to steal our IP rights and for what they are doing now…”
