When can Section 482, CrPC be invoked to direct the registration of FIRs? Madras HC answersOctober 12 2018
The Madras High Court has recently reiterated that the Court's jurisdiction under Section 482 of the Code of Criminal Procedure (CrPC) cannot be routinely invoked to direct the police to register First Information Reports (FIRs).
The Madurai Bench of Justices MM Sundresh and N Sathish Kumar clarified that this extraordinary jurisdiction of the High Court can be invoked in such cases, only after the aggrieved complainant exhausts available statutory remedies under Sections 154 (3) and 156 (3) of the CrPC.
