The Supreme Court Bar Association (SCBA) has expressed serious reservations with regard to the transfer of Justice Jayant Patel..In a press release issued today, SCBA has said that the issue of opaqueness and lack of transparency in matters of elevation and transfer of judges in the higher judiciary is a matter of grave concern..However, the SCBA has also taken serious objection to the remarks of Senior Advocate Dushyant Dave against Chief Justice of India Dipak Misra..Terming Dave’s comments as “wild personal allegations”, SCBA has stated that it amounts to denigrating the dignity and prestige of the Supreme Court of India and the entire legal fraternity..The press release states,.“The SCBA is of the firm view that the issue of opaqueness and lack of transparency in matters of elevation and transfer of Judges of the Higher Judiciary is a matter of grave concern for the entire legal fraternity and especially the Supreme Court Bar Association (SCBA)..The SCBA also has serious reservation and concern with regard in the transfer, followed by resignation of Hon’ble Justice Jayant Patel..Seeing the urgency and the gravity of the matter pertaining to the resignation of Justice Jayant Patel the SCBA has decided to share its preliminary view, till a final view is taken after deliberation by the Executive Committee, scheduled on the 1st day of reopening i.e. 3rd October 2017..However, the SCBA feels deeply anguished by baseless, scandalous and irresponsible remarks made by Mr Dushyant Dave Senior Advocate against the Hon’ble Chief Justice of India, Mr Justice Dipak Misra and other high Constitutional Authorities during the programme “Left, Right and Centre” on NDTV 24X7 on 27.9.2017. .The topic of discussion was the resignation by Justice Jayant Patel of the Karnataka High Court. Mr Dave participating in the said programme made statements without any basis against Hon’ble the Chief Justice of India making wild personal allegations. The statement made by Mr Dave clearly amounts to denigrating the dignity and prestige of the Supreme Court of India and the entire legal fraternity..We accordingly condemn the scurrilous and baseless personal attack made by Mr Dave on the head of the Institution.
