The Supreme Court today issued notice to the Delhi Police in a petition filed by Subramanian Swamy seeking a probe into the death of socialite Sunanda Pushkar..The matter came up for hearing before a Bench of Justices Arun Mishra and AM Khanwilkar..While issuing notice in the plea, the Bench observed that the issue on maintainability of Swamy’s plea remains open and will be adjudicated upon first..The Supreme Court had questioned Swamy on the maintainability of his plea, and asked him to satisfy the Court as to why his petition should be heard. This aspect has been left open by the Bench, and will be decided first, after the Delhi Police files its response in the matter..BJP leader Subramanian Swamy had earlier moved the Delhi High Court seeking a SIT-monitored probe into the death of Pushkar. After the police submitted its status report on the investigation into Pushkar’s death, Swamy had criticized the same as being “vague and convoluted” and on that was made “to obfuscate the issues”..The High Court had however dismissed his petition in October last year, with the Division Bench of Justices S Muralidhar and IS Mehta questioning the basis of Swamy’s allegations against Shashi Tharoor as well as the Delhi Police. The High Court ultimately held that it could not be persuaded that the investigation was botched or that it was under the influence of anyone..Thus, Swamy approached the Supreme Court in appeal.
