The Supreme Court today dismissed the appeals filed by Dayanidhi Maran and others against Madras High Court judgment which had refused to discharge him in the Telephone Exchange case..A Bench of Justices Ranjan Gogoi, R Banumathi, and Navin Sinha heard the appellants for around 5 minutes before dismissing the appeals..Justice Gogoi was adamant from the very beginning and when Senior Counsel Vikas Singh who was appearing in item 54.3 tried to present his case first..“Why do you want to jump the queue”, asked Gogoi J..He then proceeded to hear Dayanidhi Maran’s case first and dismissed it..“Dayanidhi Maran’s case is dismissed,” he said before proceeding to hear and reject other appeals too..“Thank you very much everybody”, he told the battery of Senior Counsel appearing for various appellants..Senior Advocates AM Singhvi, Vikas Singh, Shyam Divan and Ranjit Kumar appeared for appellants..The Madras High Court had recently set aside the trial court’s decision to discharge seven accused – including former Telecom Minister Dayanidhi Maran – in the illegal telephone exchange case..Summing up the tone of the judgment, Justice G Jayachandran had observed,.“Error, illegality, and perversity all could be pointed out in the impugned order of the trial Court.”.The case pertains to allegations that the accused – including BSNL executives, Dayanidhi Maran, his brother Kalanidhi Maran, and technicians – conspired to install a private telephone exchange at Dayanidhi Maran’s Chennai residences when he was the Union Telecom Minister..This, in turn, was alleged to have been used for business transactions involving the Sun Television Network (owned by Kalanidhi Maran), leading to a loss of Rs 1.78 crore for the public exchequer..The High Court has now directed the trial court to frame charges and complete the trial within a period of twelve months.
