The Supreme Court has reiterated that once an arbitrator has been appointed and he has assumed his role, the Court cannot be approached to appoint another arbitrator under Section 11(6) of the Arbitration and Conciliation Act, 1996 (Arbitration Act).
The Bench of Justices R Banumathi and Indira Banerjee reaffirmed this position in an appeal case filed against the dismissal of petitions challenging the appointment of an arbitrator.
