Union of India & Ors rendered in 2002..States that had not yet implemented post-retirement schemes for retired judges, had been asked to respond in the matter..When the matter was heard on September 26, the Court had expressed its shock at the fact that Delhi had not made any provisions for allowances to retired High Court judges..“Shockingly and surprisingly, the Government of NCT of Delhi has not made any provision for allowances to retired Hon’ble Chief Justices and retired Hon’ble Judges of the Delhi High Court”, it had stated in its order..It had then directed the Chief Secretary of the State to look into the matter and report to the court in-person at the next hearing..“We direct the Chief Secretary of the Government of NCT of Delhi/Delhi Administration to look into the matter and report to the Court on or before 8th November, 2016. We also direct the Chief Secretary of the Government of NCT of Delhi/Delhi Administration to appear in person on the next date fixed in the event there is any difficulty in sanctioning the allowances to the retired Hon’ble Chief Justices and retired Hon’ble Judges of the Delhi High Court at least at par with what is being offered by other States.”.When the matter was taken up today, Solicitor General Ranjit Kumar told the Court that the Chief Secretary, KK Sharma is present in court.
