The Supreme Court today came down on advocate ML Sharma, for filing a PIL with unfounded claims against Union Ministers including the Prime Minister and the Finance Minister..Sharma in his petition had sought an independent probe into the Nirav Modi – Punjab National Bank scam that rocked the nation a few months ago..When it was taken up for hearing by the Bench of Chief Justice of India Dipak Misra and Justices AM Khanwilkar and DY Chandrachud, Attorney General KK Venugopal pointed out that the petition makes some “scandalous allegations” against the Prime Minister and Finance Minister of the country..With the Court rebuking the petitioner for making such unfounded allegations, Sharma told the Court that he is ready to remove the objectionable portion of his petition..Justice Chandrachud, however, expressed his disapproval in strong words saying,.“Such kinds of PILs that tarnish someone’s name and reputation without any basis should stop.”.Venugopal also submitted that a charge sheet has already been filed in relation to the matter and the prayer made for an independent inquiry free from government control in the petition is based on the “scandalous allegations” against the Prime Minister and Finance Minister..With the petitioner pressing for the Court to hear his petition, promising to remove the contentious allegations, Justice Chandrachud said,.“This is why there is a great (unclear) about PILs. These are the kind of petitions that come. You read newspaper articles and come here and file PILs… You take names of political leaders without any basis.”.The Court then proceeded to dismiss the petition with the order that the Court is not inclined to entertain the petition on the grounds of “unwarranted and uncalled for assertions made in the petition…”
