Managing Editor of the India Today group, Rahul Kanwal has agreed to tender an unconditional apology to Brigadier PK Tikoo in relation to a news item telecast in 2010 in India Today channel (then called Headlines Today)..The matter came up for hearing yesterday before a Bench comprising Justices Arun Mishra and Amitava Roy which recorded the readiness of Kanwal to tender apology to Tikoo..The apology will be broadcast on February 19, 2018 between 10.00 p.m. to 10.30 p.m on India Today channel..The genesis of the controversy lies in an episode telecast on India Today on July 20, 2010. The said episode anchored by Kanwal had aired a tape containing an alleged telephonic conversation between Tikoo and one Vinod Gandhi..As per the recorded conversation, Tikoo had allegedly threatened Gandhi of dire consequences if his money, which was invested in a business, was not returned..Tikoo had, however, denied the authenticity and genuineness of the same and had contended that the same was done to malign his reputation and goodwill. Tikoo had also accused Gandhi of using his recording studio for achieving his sordid aims..Tikoo, therefore, filed a defamation suit case against Gandhi and Kanwal before Special Mobile Magistrate, Jammu and they were summoned in 2010 by the Magistrate in 2010..The defamation petition was contested by Kanwal before the Jammu & Kashmir High Court but the same was dismissed by the High Court on the ground that the petition lacked merit. This led to appeal in Supreme Court..In the Supreme Court, Kanwal offered to tender an unconditional apology to Tikoo. Tikoo agreed to the proposal whereupon the Court proceeded to record the same while ordering that the defamation case against Kanwal will stand dropped..“1. It is happily agreed by learned counsel for the parties that an unconditional apology will be broadcast on 19.2.2018 between 10.00 p.m. to 10.30 p.m..2. In case the broadcast is made, as agreed above, the complaint 561 A Cr.P.C.No.227/2010 shall stand dropped, vis-a-vis to Mr. Rahul Kanwal..3.
