Patiala House Court has directed the Delhi Police to register a First Information Report against Republic TV and its editor-in-chief Arnab Goswami in a complaint filed by Shashi Tharoor..Tharoor had filed a complaint against Arnab Goswami for allegedly accessing confidential documents relating to the probe in Sunanda Pushkar’s death. In his complaint, Tharoor alleged that these documents formed part of the investigation report in the case and were part of internal notings of the Police records..The complainant further alleged that RTI replies by the Delhi Police have shown that it is impermissible to share details of the probe with the public or media pending investigation..It is also alleged by the complainant that the Channel deliberately made defamatory remarks against him “in an attempt to increase the viewership of their News Channel.”.The Channel is also alleged to have accessed Tharoor’s emails without his consent in addition to accessing confidential documents on their News Shows relating to Sunanda Pushkar’s death..“It is alleged that proposed accused persons illegally accessed those confidential documents and shown/broadcast them on their News Channel. It is alleged that proposed accused persons accessed the complainant’s Email account without his authority or consent and shared the personal Emails on their News Channel.”.The complainant (Shashi Tharoor), was represented by Senior Advocate Vikas Pahwa with Advocates Gaurav Gupta and Muhammad Ali Khan, has claimed that he had filed Police Complaints regarding the theft of documents and his Email hacking but no action has been taken by the Police yet..Tharoor has sought directions to be given to the Delhi Police to initiate action based on the complaint..Metropolitan Magistrate Dharmender Singh, in an order passed on January 21, has thus, directed the Delhi Police to register an FIR against the accused persons..“This court is of the considered view that in view of allegations leveled by complainant and material produced on record in the form of RTI replies and other material, matter disclosed commission of cognizable offence..In these circumstances, SHO concerned is directed to register FIR in this matter and investigate the same as per law.”.Read the Order:
