Youth Bar Association of India seeks intervention in Judge Loya case in Supreme Court

Youth Bar Association of India has filed an intervention application in the Supreme Court in the case seeking probe into the death of Judge Loya.

The matter is coming up for hearing tomorrow before a Bench headed by Chief Justice Dipak Misra.

The intervener has contended in its application that the developments in the case of judge Loya’s death have raised serious questions on the functioning of the lower judiciary.

The intervener has apprised the Court about a letter petition that was sent by them on December 1, 2017.

The letter petition, which deals with media reports pertaining to the death of the Judge Loya alleges that there are many questions surrounding the death of judge Loya, which remain unanswered.

It has highlighted seven issues which arise out of the media reports and have not yet been answered.

The issues are:

  • Loya experienced chest pain. How did he get to the hospital?
  • At Dande hospital, was ECG taken or not?
  • Declared dead at Meditrina hospital.
  • Time of Death?
  • Post mortem and after
  • Blood on judges clothes.
  • Transporting the body.

The intervener in the letter petition had cited media reports pertaining to the seven issues and had sought the indulgence of the Court to take cognizance of the matter and direct a fair and impartial inquiry into the death of the judge.

Expressing its keenness to assist the Court in the matter, the application states,

“the applicant association respectfully prays this Hon’ble Court to take assistance of the young members of the bar who deems the above-said issue as the large public interest which has far reaching consequences.”
