Why Allahabad High Court Bar Association has resolved to abstain from work tomorrow

The Allahabad High Court Bar Association has decided to abstain from work on July 10, Wednesday citing concerns over the High Court Administration's failure to address certain issues plaguing the lawyers, particularly the conduct of certain judges towards the bar. .A letter informing the same was sent by the bar body to Chief Justice Arun Bhansali on Tuesday.The letter to Chief Justice Arun Bhansali was written following a meeting of the Governing Council of the bar body which was presided over by President Anil Tiwari and Secretary Vikrant Pandey..In the meeting, the High Court Bar Association expressed concerns that the current situation was damaging and affecting the administration of justice. To protect justice and uphold the rule of law, the following decisions were taken at the meeting:(a) The members of the High Court Bar Association, Allahabad shall abstain from judicial work on July 10, 2024 (Wednesday) (b) For further course of action, the Executive Committee of HBA will again meet at 05:00 pm on July 10.(c) For all the aforesaid demands, the request letter be sent to Hon'ble The Chief Justice for his Lordship for information and for taking necessary steps, so that corrective measures are ensured. (d) If any Advocate is found in the court contrary to the resolution, his membership will be canceled after giving him an opportunity by issuing a show cause notice..The letter raised the following concerns:Court conduct of Justice Rohit Ranjan Agarwal in Court No 69As per the letter, Justice Agarwal's court conduct deviates from the established procedures and longstanding traditions of the High Court. Additionally, Justice Ranjan is not adhering to the mandates set by the Supreme Court. Further, there have been instances of insulting remarks made against lawyers..Behavior of some judges towards the lawyers and BarThe President informed the Chief Justice and requested intervention with respect to the conduct of certain judges towards lawyers but no action has been taken and the situation persists, it was alleged.The Bar, aware of its duty to the courts, is determined to take steps to protect the Court's dignity and address this issue..Judges do not follow old tradition to revise the list of fresh cases/ unlisted cases The bar body also raised concerns over deviation from certain established practices as regards listing of cases."High Court is now significantly stretched, making it challenging for many advocates, especially those over 60, to attend all courts simultaneously. Therefore, there is a demand to restore the tradition of the High Court by revising the call in all courts in a practical manner, rather than symbolically," the letter said..The letter further stated that changing the process of filing and reporting through judicial orders without amending the High Court Rules and contrary to the existing Rules, creates significant difficulties for advocates. Additionally, the Bar's request for data on advocate roll numbers along with other requests have been denied by a written order from the Registry, it was added.."It is the duty of Bar to enforce the provision of "One Bar One Vote" and to protect and to safeguard the administration of justice by removing unwanted persons and nuisance from the role members of BAR, who have got membership by concealing material facts and also got the Advocate Roll Number from the Hon'ble High Court but the court administration is not cooperating," the letter stated..[Read Letter]
