UP Court hails CM Yogi Adityanath; says communal riots due to appeasement of one community

India suffers from communal riots due to appeasement of a particular religious community by political parties, a sessions court in Bareilly recently said while also lauding Uttar Pradesh's Chief Minister Yogi Adityanath for being the perfect example of a religious person who holds a seat of power with dedication and sacrifice..Additional Sessions Judge Ravi Kumar Diwakar made the observation while summoning Maulana Tauqeer Razam, a Muslim cleric, in the 2010 Bareilly riots case."The main reason for riots in India is that the political parties here are engaged in appeasement of a particular religion, due to which the morale of prominent people of that particular religion increases so much and they believe that even if riots etc. if they get it done, not even a hair will be left unturned due to power protection," the judge said.He further noted that the cleric appeared to have been the mastermind behind the communal riots.After noting that the police (in 2010) appeared to have tried to support the cleric by not mentioning him as an accused in the chargesheet, Razam has now been ordered to appear before the trial court on March 11..The judge added that a more recent speech by Razam could have triggered another riot in the State had there been no government led by Yogi Adityanath in Uttar Pradesh.The matter prompted the Court to draw parallels between Chief Minister Yogi Adityanath and the concept of a Philosopher King, a term coined by Plato in his book, Republic."If a religious person sits on the seat of power, he gets very good results, as propounded by the philosopher, Plato in his concept of the Philosopher King in his book Republic. Plato said that there will be no end to suffering in our city states until philosophers become Kings," the judge explained in his March 5 order. .The judge added that while the word justice is used today in a legal sense, at the time of Plato, the word was used in a religious sense. "Therefore, the head of power should be a religious person, because the life of a religious person is not of enjoyment but of sacrifice and dedication. In this regard I would also like to mention the fear prevalent in the society," the judge remarked. .Judge says he received threats after order in Gyanvapi Masjid case.The judge also claimed that due to certain orders he had passed earlier in the Gyanvapi Masjid dispute, he received threats from a Muslim organisation. He said that a 32-page letter containing threats was received and that a criminal case was also filed over the matter in Varanasi. He expressed displeasure over the fact that none have been arrested in the case yet."But since no one has been arrested yet, my mother who lives in Lucknow and younger brother Dinesh Kumar Diwakar, who is working as Civil Judge (CD) FTC in Shahjahanpur, remain worried about my safety. And I am about their's. Especially my mother is so worried about my safety that she cannot speak through a choked throat," the judge said..The judge added,"My children also ask me that Papa, it is being shown in the news channel that you will be killed. Then I explain that son, all this is being shown as a lie, then the children say that Papa, in our school, friends also say that your father will be killed, so you cannot fool us. The fear is so much that some time back an attempt was made by Maulana Tauqeer Raza Khan to again incite riots in Bareilly city and derogatory things were also said by Maulana Tauqeer Raza Khan against the Prime Minister of India Shri Narendra Modi, which my wife also heard and said that when this person can say derogatory things about the Prime Minister of the country, then he can do anything. A few days ago, a riot would have been organized in Bareilly by Maulana Tauqeer Raza Khan, if at present there was no government of Shri Yogi Adityanath ji in Uttar Pradesh.".The judge highlighted that an atmosphere of fear prevails in his family, in a that is difficult to express it in words. Everyone in the family is worried about each other's safety. One has to think many times before leaving the house, the judge stated. "This fact is also noteworthy that ever since I have given the verdict in the Gyanvapi case, the attitude of people of a particular religion and officials towards me has become strange, as if it seems that I have committed some sin by giving the verdict in the Gyanvapi case ... In the Gyanvapi case I gave it under the legal provisions," the judge underlined. .The present order was passed in a case concerning the 2010 Bareilly riots. .The Court termed Maulana Tauqeer Raza Khan the main mastermind behind the riots and questioned why he was not included in the charge sheet, despite there being sufficient evidence to proceed with a probe against him.This shows that the police officers of the time, as well as the administrative officers and government-level officials had failed in their duties, the judge said."The rules were not followed and the mastermind who instigated the riots, Maulana Tauqeer Raza Khan, was deliberately supported," the judge said..Maulana Tauqeer Raza Khan (President of the Ittehade Millat Council) is alleged to have given a speech to a Muslim gathering in 2010, in which he said that he was against Hindus, that he would shed rivers of blood, destroy their houses and shops, set them on fire and get them looted. After this speech, the judge noted that riots broke out in Bareilly on March 2, 2010."The police post was set on fire and the houses of Hindus were set ablaze and women were treated indecently. Therefore, in the interest of justice, an FIR has been lodged against the accused Maulana Tauqeer Raza Khan under relevant provisions of the Indian Penal Code (IPC) and the Prevention of Damage to Public Property Act. Thus, the grounds for summoning for trial are found sufficient," the judge said. .The Court, therefore issued summons to Maulana Tauqeer Raza Khan to appear on March 11. .[Read Order]
