The Rajasthan High Court recently ruled that in cases where there is total lack of prosecution evidence to substantiate the charge against accused, the acquittal should not be categorised as “benefit of the doubt” but must be recognized as a “clean acquittal” [Ghanshyam vs State of Rajasthan].
