Delhi High Court
1. Manohar Lal Sharma Advocate Vs Union of India & Ors.
[Item No 32, Court 2- WP (Crl) 2001/2015]
Bench: BD Ahmed J., Sanjeev Sachdeva J.
A fresh petition.
Today in Court: Sharma had filed a fresh application in the matter that was dismissed by the same Bench, previously. Today Sharma sought to attack the Additional Solicitor General Sanjay Jain, by submitting before the Court that P-Notes were neither regulated or registered with the SEBI and therefore, the ASG’s statement made during the previous hearing was erroneous.
Sharma also told the Court that he had included SEBI & RBI as parties to the said petition and if his facts were wrong, he was “willing to undergo punishment” imposed by the Court. The Bench, however was not inclined to pass any fresh order in a matter which was previously adequately heard and dismissed and therefore, proceeded to dismiss the applications.
2. Rahul Gandhi Vs Subramanian Swamy & Anr. [Batch of 5 matters]
[Item No 14-18, Court 16- Crl M.C. 3332/2014]
Bench: Sunil Gaur J.
The case pertains to the National Herald scam based on a complaint made by Dr. Subramanian Swamy against certain Congress leaders. Swamy had alleged cheating and misappropriation of funds in the acquisition of the newspaper by Young Indian (YI).
The summons issued by the trial court had been challenged before the HC in July 2014. In the month of December, the High Court had stayed the summons and ordered for the case to be heard on a day-to-day basis.
Before the last hearing, due to the listing of the matter before a different Bench, the Petitioners had moved an application before the Court to transfer the matter that was partly heard, before the same Bench headed by Justice Gaur. When it was heard on Friday, Justice Gaur termed those applications as “infructous” as the case had been transferred to his Bench already.
Today in Court: The Bench did not assemble today. The matter will now be heard on November 6.
