The Delhi High Court on Friday denied bail to Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar in the case relating to assault of Member of Parliament (MP) Swati Maliwal. .Justice Anoop Kumar Mendiratta said that even though Kumar happened to be just the personal secretary of the Chief Minister of Delhi, he wields considerable power and can influence witnesses..The trial court had rejected Kumar's bail plea twice. First, the Court denied him bail on May 27 and then on June 7. .Kumar was arrested by the Delhi Police on May 18. He was then remanded to police custody for five days. On May 24, he was sent to judicial custody.Maliwal is the Rajya Sabha Member of Parliament (MP) from Aam Aadmi Party (AAP). She has alleged that she was assaulted by Kumar at Kejriwal's residence. As per the FIR, Kumar hit Maliwal in her chest, stomach and the pelvic area with legs.AAP has countered allegations. Some videos have also surfaced on social media showing Maliwal having an argument with the security personnel and walking out of the Chief Minister's residence..In his bail plea, Kumar argued that the trial court dismissed his bail application without considering the fact that the he has already suffered "undue incarceration" and as of date has been under custody for more than 25 days.Kumar said that he had also lodged a complaint against Maliwal but the same is not being investigated because she is an influential person. He further contended that Maliwal's allegations against him are not only "unbelievable/unnatural, but clearly depict the falsity in the same"."The entire incident as disclosed by the Complainant, is a result of a well-thought strategy and after-thought, wherein a detailed written complaint has been submitted after due deliberations and with an intent to falsely implicate the Petitioner herein," Kumar contended.
