Supreme Court stays UP decision to shift students in unrecognised Madrasas to govt schools

The Supreme Court on Monday stayed the Uttar Pradesh (UP) government's recent order directing that all students in unrecognised madrasas and non-Muslim students studying in government-aided madrasas should be shifted to government schools

The plea by Jamiat Ulama in Hind was filed challenging UP government's order which was based on a letter by the National Commission for Protection of Child Rights (NCPCR).

The Court stayed the NCPCR's communication as well as the steps taken by the State pursuant to the communication.

"Issue notice. Communications by June 27 issued by NCPCR on June 7 and June 25 is stayed and all consequent steps taken are stayed," the Court directed.

A different petition is pending before the Supreme Court challenging the Allahabad High Court's March 22 decision to strike down the Madrasas Act, 2004.

The top court had stayed that judgment on April 5.
