#Breaking: Supreme Court seeks UP AG Raghvendra Singh’s personal presence, stays Allahabad HC order

The State of Uttar Pradesh has appealed to the Supreme Court against the order passed by the Allahabad High Court summoning Chief Secretary in a case and rebuking Advocate General Raghvendra Singh for not appearing in the case despite repeated calls..The Supreme Court today stayed the impugned orders of the High Court but has sought the personal presence of Singh to explain his conduct..The matter was heard today by a Bench of Justices Arun Mishra and Mohan M Shantanagoudar. Additional Solicitor General PS Narasimha appeared for Uttar Pradesh..The Court, after hearing the ASG, stayed the three orders passed by the High Court..“The operation of the impugned order dated 28.07.2017 and the subsequent orders passed by the High Court on 31.07.2017 and 01.08.2017 are hereby stayed.”.The Court has, however, asked Narasimha to ensure the personal presence of the Advocate General to explain why he failed to appear before the High Court, despite repeated calls..“….we request Mr. P.S. Narasimha, learned Additional Solicitor General to keep the Advocate General for the State of U.P. present in Court so as to show why he did not appear when the High Court called him.”.In an order passed on July 28, the Allahabad High Court had expressed severe displeasure at the Advocate General’s absence from the court despite being called multiple times. A Division Bench of Justices Ramesh Sinha and Rekha Dikshit had gone to the extent of asking the Chief Minister to look into the matter, while strongly berating the AG for his conduct..It had stated in its order that the AG’s not responding to the court’s repeated requests,.“amounts to utter disregard and disrespect to the Court and has set a bad example to the learned State Counsel as well as learned members of the Bar who are present in the Court as also before the whole legal fraternity…..The attitude and conduct of the learned Advocate General in not appearing before the Court amounts to contempt of the Court in spite of repeated calls sent to him”.The case before the Supreme Court is now listed for hearing on August 4..Read the Supreme Court order below.
