The Supreme Court of India yesterday dismissed the Curative Petition filed by Kerala in the Soumya murder case..A six-judge Bench of Chief Justice JS Khehar and Justices Dipak Misra, Jasti Chelameswar, Ranjan Gogoi, PC Pant and UU Lalit dismissed the petition with a short order that states,.“Having gone through the Curative Petitions and the relevant documents, in our considered opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra Vs. Ashok Hurra & Anr., reported in 2002 (4) SCC 388. The Curative Petitions are, accordingly, dismissed.”.The Kerala state government had filed the petition after the Supreme Court had set aside the Kerala High Court judgment awarding the assailant Govindachamy the death penalty..The apex court Bench comprising Justices Gogoi, Pant and Lalit had, in September last year, found Govindachamy guilty of rape and sentenced him to life imprisonment instead.
