Three courts are now seized of the issue of age-limit prescribed for admission to LL.B. course in India..After the Supreme Court and Allahabad High Court had issued notice in petitions concerning the same, it is now the turn of the Rajasthan High Court..In a petition filed by one Anmol Sharma, the High Court has issued notice to the Bar Council of India (BCI) and Chanakya National Law University (CNLU). It also granted interim relief by allowing the petitioner to apply and participate in the Common Law Admission Test (CLAT) subject to further orders..The order was passed by Justice Mohammed Rafiq..The decision to adopt the age limit for this year’s exam stems from a Bar Council of India notification passed in September, which claimed that Clause 28 of Schedule III, Rule 11 of the Rules of Legal Education, 2008 stood “revived”. That rule imposes an age-limit for entry into law courses..The Supreme Court had issued notice in the challenge to the age-limit. This was in a petition filed by one Rishabh Duggal. A little over a week ago, an orphan IDIA Scholar had also impleaded himself in the petition..The Allahabad High Court had also issued notice in a similar challenge and allowed the petitioners to take CLAT in the interim. That order was passed by a Bench of Chief Justice DB Bhosale and Justice Yashwant Varma which also noted that the BCI is planning to file a transfer petition in a bid to club the challenges to Clause 28 pending in various high courts with the petitions in the apex court..The petitions in the Supreme Court are likely to be heard this coming Monday after Senior Advocate Sanjay Hegde mentioned the matter before Chief Justice JS Khehar yesterday, citing urgency, since the exam is scheduled to be held on May 14..HT to @Pururaj_Agarwal for the copy of the order.
