[Sunday hearing] “Courts must have due regard for religion”: Madras High Court allows undertrial to attend father’s last rites

Justice GR Swaminathan said that while the petitioner was not entitled to bail, or even interim bail, the Court can grant him relief by exercising its inherent jurisdiction under Section 482 of the CrPC.

The Madras High Court held a special sitting on Sunday, February 11 to allow an undertrial in a narcotic case to attend the last rites of his deceased father, given that he was a “Hindu” and as the eldest son, was required to “discharge certain religious obligations.”
