Shahrukh Pathan gets bail in Delhi riots case but will remain behind bars in FIR for pointing gun at cop

The Court noted that Pathan has been in judicial custody in the case since April 2020 and all the co-accused have been granted bail.

Shahrukh Pathan, the man who was seen pointing a gun at cop during the Delhi riots of 2020, was granted bail by a Delhi court in another case connected to the riots.

He was granted bail in a case related to causing injuries to several police personnel and gunshot injury to one Rohit Shukla during the clash between anti and pro Citizenship Amendment Act (CAA) protestors.

He will, however, continue to remain in jail since he is yet to get bail in the case registered for brandishing gun at the cop.

Additional Sessions Judge (ASJ) Amitabh Rawat of Karkardooma court granted bail to Pathan in the gunshot injury case after noting that he has been in judicial custody since April 2020 and the other co-accused have been granted bail.

The Court further observed that in the present case, Pathan is not accused of shooting at Rohit Shukla but is accused of being part of the riotous mob which shot at Shukla.

“The court is conscious of the fact that the conduct of the accused in this case before he was arrested and even during trial, during judicial custody has been atrocious. However, it remains a fact that he has been judicial custody since 03.04.2020… The court is also conscious of the fact that accused Shahrukh Pathan is also involved in another riot case FIR No.51/2020 PS Jafrabad where he is stated to have made an attack on the life of the police official, however, said case will be dealt with on its own facts,” the Court concluded.

It, therefore, ordered granted him bail subject to him furnishing a bond of ₹50,000. 

Pathan is accused of several offences including for rioting, unlawful assembly promoting enmity between different groups.

In December 2021, charges were framed against him under Sections 147, 148, 149, 186, 188, 153A, 283, 353, 332, 323 and 307 of the India Penal Code.

Special Public Prosecutor Anuj Handa appeared for the Delhi Police.
