The stand-off between members of the Executive Committee (EC) of the Supreme Court Bar Association (SCBA) seems to be far from over..The latest in the series of dis-chords is the information on the website of the SCBA stating that “President Mr. Dushyant A. Dave (Sr.) has resumed the office of President SCBA”..The details of the same are contained in notice under the head ‘Secretary notices’ though the Secretary has not signed the said notice. The notice is uploaded as “MINUTES OF THE MEETING HELD ON 18-03-2016” and contains minutes of two separate meetings held on March 18..First meeting – 1.10 pm sans Dushyant Dave.As per the notice, the first meeting was attended by 8 members of the Executive Committee and was held at 1.10 pm. It was presided by Senior Advocate Sukumar Pattjoshi. It states that the 10 members of the Executive Committee accepted by voice vote on March 17, the withdrawal of resignation given by Senior Advocate Dushyant Dave. It also states that the Committee “felt that the resignation of Mr. Dushyant A Dave vide letter dated 15.02.2016 was addressed to the General Body of SCBA and therefore, it was not yet accepted by the General Body and thus he never ceased to be the President.”.The minutes proceed to state that Dave entered and chaired the meeting thereafter..It ends by stating that the ‘minutes register’ has been “kept in lock and key” by the Hon. Secretary and therefore, the signature could not be obtained in the Register..Second meeting – 1.30 pm chaired by Dushyant Dave. The second meeting has 10 members of the Executive committee in attendance. Apart from Dave, who chaired this meeting, Senior Advocate Jitendra Mohan Sharma is the new addition (SCBA Secretary Gaurav Bhatia has disputed this and said that Sharma never attended this meeting and that Sharma even sent a message to Bhatia stating the following: “My name appears in a alleged EC meeting today…….All members were in the meeting room. Surprisingly my presence is shown as if I have attended meeting. This is not correct. No resolution was ever passed.”).As per the minutes of the second meeting, it was resolved.“to convene a General Body meeting to consider the course of functioning of the Executive Committee.”.This meeting will be held at the Plaza canteen of the Supreme Court on March 31 at 4.10 pm..Two more meetings in the offing – EC v. General Body.SCBA Secretary Gaurav Bhatia had already stated on record that the meetings convened on March 18 were illegal. 11 members of the Executive Committee have also decided to meet on March 29 to decide on the withdrawal of resignation by Dushyant Dave as reported by Bar & Bench on March 19..It remains to be seen whether the impasse will be resolved before that or not..Read the minutes of the meeting held on March 18 below.
