The impasse in the Supreme Court Bar Association seems to have finally ended. The Executive Committee (EC) of the SCBA met and decided to accept Dushyant Dave’s withdrawal of his resignation from the post of President..Acting President Ajit Kumar Sinha presided over the meeting held today at 1.05 pm today and unanimously resolved to accept the withdrawal of resignation “in due deference to the request made by the Chief Justice of India” and “in the larger interest of the Bar”..After the withdrawal of resignation was accepted, Dave was asked to join the meeting..The EC has, however, also resolved that the meeting convened on March 18 by certain members of the EC and all follow up action “is non-est and contrary to SCBA Rules”..The controversy had begun with the resignation of President Dushyant Dave owing to differences with Secretary Gaurav Bhatia and his subsequent withdrawal of the resignation. A few members of the EC had met on March 18 to accept the withdrawal of resignation and asked Dave to preside over the meeting..Secretary Gaurav Bhatia had, however, asked Dave not to attend the meeting since his withdrawal had not been accepted. The move had led to much chaos within the Supreme Court premises..Subsequently, minutes of the said meeting were uploaded on the website of SCBA even as 11 members of the EC continued to maintain that the said meeting was illegal..These 11 members had then issued a clarification “on behalf of the SCBA Executive Committee” that the meeting of March 18 was illegal and Senior Advocate Ajit Kumar Sinha continued to be the acting President. It had also resolved to meet today to take a decision on the withdrawal of resignation by Dave..In the allegedly “illegal meeting” of March 18, ten members of the EC had resolved to hold a General Body meeting on March 31. It now remains to be seen whether the SCBA would go ahead with that meeting or not.
