Two days after the Supreme Court of India directed movie theatres across the country to play the National Anthem before the screening of films, it has rejected, on technical grounds, a plea seeking to impose the same rule in courts..The matter was mentioned by advocate Ashwini Kumar Upadhyay before a bench of Justices Dipak Misra and Amitava Roy, the same bench which passed the November 30 order..Today, Upadhyay requested the court to slightly modify the aforementioned order or to pass an executive order to make the National Anthem compulsory for all the subordinate courts, district courts and higher courts including the, Supreme Court..According to various news reports and tweets, the Court refused to entertain the plea, after Attorney General Mukul Rohatgi submitted to the court that the Centre could not give its response to the plea, as no formal petition has been filed in this regard..The court also reportedly observed that its order dated November 30 should not be “overstretched”..According to India Today, the Court observed:.“The national anthem is not mandatory at the Supreme Court. There is no proper petition before the court in this regard. We can’t impose it across the bar in this manner.”.Upadhyay has now expressed an intention to file a formal petition to this effect. Whether or not the Court will entertain the idea once it has been filed is what remains to be seen.
