The Supreme Court today referred the Female Genital Mutilation case to a Constitution Bench.
The order was passed by a Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud after a request to that effect was made by the Attorney General KK Venugopal and Senior Advocate Mukul Rohatgi.
“I am of the opinion that this matter should be referred to Constitution Bench”, submitted Venugopal.
Rohatgi appearing for Dawoodi Bohra community also supported the same.
The petitioners opposed the request saying that each and every case should not be referred to Constitution Bench.
“This is not a question of every case. This is a very important case”, retorted Rohatgi.
The Bench then acceded to the request and referred the matter to Constitution Bench.
