NJAC: Pronounce on referral to larger Bench before going into the rest of the case, AG Rohatgi tells Supreme Court.Attorney General Mukul Rohatgi is continuing with his submissions in the challenge to the National Judicial Appointments Commission (NJAC). Rohatgi’s arguments pertaining to the correctness of the Second Judges case is still in progress and he is yet to argue on the Constitutionality of NJAC. Yesterday, he had convinced the Bench to hear him on the correctness of the Second Judges case first after which he said he would argue on the Constitutionality of NJAC independent of what has been decided in the Second Judges case. The Bench, though initially hesitant, had finally agreed to his proposition. If the submissions of the AG pertaining to the Second Judges case are to be accepted, the matter will have to be referred to a larger Bench since the Second judges case was decided by a 9 judge Bench..Today the Attorney General went a step further and suggested that the Court, after hearing him on the correctness of the Second Judges case, should pronounce on the limited question of whether the matter should be referred to a larger Bench or not before hearing him on the Constitutionality of NJAC. He said that otherwise it will be a waste of court’s time if the court finally refers the case to a larger Bench..The Court said that it would consider his submission.
