Senior Advocate Colin Gonsalves is representing the victim..SC issues notice in DMK leader’s plea challenging Bhavani Singh’s appointment as Public prosecutor. The Supreme Court today issued notice in an appeal filed by General Secretary of Dravida Munnetra Kazhagam, K Anbazhagan challenging the appearance of Bhavani Singh as the Special Public Prosecutor in the appeal filed by Jayalalithaa in the Karnataka High Court in the disproportionate assets case..Senior Advocate TR Andhyarujina appeared for Anbazhagan. Anbazhagan has contended that the notification by the Karnataka government appointing Bhavani Singh as the public prosecutor in the trial before the Special judge will not automatically empower him to appear in High Court to conduct appeal. Such an act, he has claimed, is in violation of Section 24 of the Code of Criminal Procedure (CrPC) and will not be protected by Section 301 of the CrPC..Observing that the case involves a substantial question of law, the Court issued notice to the Karnataka government and Bhavani Singh and posted the matter for March 18. The Court, however, refused to stay the appeal proceedings in the High Court..Coal Scam: Bhushan seeks investigation into Coal diversion and Hindalco raid.Advocate Prashant Bhushan today sought CBI investigation into two separate cases related to coal scam. One case pertains to the diversion of Coal by Reliance Energy for its own commercial use from Sarsen Coal fields. Taking note of Bhushan’s submissions, the Court asked the CBI to furnish details, if any, regarding investigation into the same and said that it would consider the same during the next hearing..The other issue concerns the raid that happened at the Hindalco office sometime back during which allegedly unaccounted money was recovered. The probe in that matter was handed over to the Income Tax Department. Bhushan advocated for a CBI probe into the matter but the Court did not give any categorical direction and instead remarked that “we will see”..Meanwhile, the CBI filed a fresh status report today and informed the Court that it has filed cases against 35 companies..The matter will now be heard on April 27.
