NRI Voting: Centre informs Supreme Court that it agrees with the suggestions of the Election Commission.The Central government, through Additional Solicitor General PS Narasimha, informed the Supreme Court today that it is in agreement with the suggestions of the Election Commission of India (EC) to facilitate voting for Non Resident Indians (NRIs). The matter was heard by Chief Justice HL Dattu and Justice AK Sikri..The EC, in a Public Interest Litigation filed by one Dr. Shamsheer, had submitted a report wherein it had suggested two ways to enable NRIs to cast their votes: E-Postal ballot and proxy voting..In the E-Postal ballot system, the postal ballot will be transferred by the Returning Officer to the NRI electronically and the NRI will send the marked postal ballot by post to the Returning Officer. In proxy voting, the voting will be through a proxy appointed by the overseas elector..Narasimha also told the Court today that it will now devise means to ensure that the suggestions of the EC are implemented. The Court then proceeded to record in its order that the Centre has to inform the Court about the steps taken by it to implement the EC’s suggestions..Section 66A: New Bench to hear the case.Justice Rohinton Nariman has replaced Justice SA Bobde in the hearing pertaining to the challenge to Section 66A of the Information Technology Act, 2000. The Bench will be presided by Justice Jasti Chelameswar who was presiding the earlier Bench along with Justice Bobde..The final hearing in the case had made fair progress with Senior Advocates including Soli Sorabjee and Sajan Poovayya and advocates including Sanjay Parikh, Prashant Bhushan and Gopal Sankaranarayanan completing their arguments..Italian marines: CJI refers plea for extension of stay to another Bench.A Bench presided by Chief Justice HL Dattu today referred to another Bench, the plea made by one of the marines to extend his stay in Italy. This was on the ground that the Bench had earlier made some observation in a similar plea made earlier. The marine had undergone a heart surgery on January 5. Taking into account the new “developments” in the case, the Court held that,.“Having made the observations on the application filed earlier, we deem it not proper to take up the application for hearing and post it before another Bench day after tomorrow.”
