Maharashtra Cabinet Minister Nawab Malik and former State Home Minister Anil Deshmukh have approached a Mumbai court seeking bail for a day to cast his vote at the Rajya Sabha polls scheduled to be held on June 10..Malik is presently in judicial custody for his alleged involvement in a money laundering case under the Prevention of Money Laundering Act (PMLA) involving underworld don Dawood Ibrahim..Deshmukh, who is also in judicial custody, is the prime accused in the probe initiated by ED after Central Bureau of Investigation (CBI) filed FIR following a Court-directed enquiry.Special PMLA Judge RN Rokade will hear both applications on June 8..Both applications pointed out that the only voters in the Rajya Sabha elections are elected members of the legislative assembly and voting is conducted inside the Vidhan Bhawan.Since they are MLAs and members of the electoral college for election of members,they should be allowed to cast their votes, the plea said. .Malik stated in his application filed through Rashmikant & Partners that after getting permission from the Court, he was undergoing medical treatment at a private hospital.Accordingly Malik sought permission to be taken in an ambulance under medical supervision for a few hours so that he can vote in Biennial Elections and then be taken back to the hospital where is under treatment. Malik assured the Court that he would bear the medical and police escort expenses..Deshmukh’s application on the other hand pointed out that availability of police escort may not be a hurdle as only 288 MLAs will be casting votes in the premises of Vidhan Bhawan.Deshmukh in his plea filed through advocate Aniket Nikam, also assured the Court that he will pay police escort charges.
