A court in Rajasthan on Tuesday acquitted dargah cleric Syed Gohar Husain Chisti and five others accused of chanting 'sar tan se juda' (beheading) slogans against former Bharatiya Janata Party (BJP) spokesperson Nupur Sharma in June 2022..Additional District and Sessions Judge Ritu Meena passed the judgment acquitting all six accused..Chisti and others allegedly raised the slogan, "gustakhi-e-nabi ki ek hi saza, sar tan se juda, sar tan se juda", (One punishment for insulting the prophet - beheading) at a public protest in Ajmer against Nupur Sharma's comments about Prophet Muhammad in May 2022.After a video of the incident surfaced on social media, Chisti left Ajmer and took refuge in Hyderabad, from where he was arrested on July 15. He was booked under Sections 115 (abetment of offence punishable with death or imprisonment for life if offence not committed), 117 (abetting commission of offence by the public or by more than ten persons.), 143 (punishment for being member of unlawful assembly), 149 (every member of unlawful assembly guilty of offence committed in prosecution of common object), 188 (disobedience to order duly promulgated by public servant.), 302 (punishment for murder), 504 (intentional insult to provoke breach of peace) and 506 (punishment for criminal intimidation) of the Indian Penal Code (IPC)..According to the State, provisions of Section 155 (information as to non-cognisable cases and investigation of such cases) and 302 (murder) were attracted owing to incidents of beheading in Amravati and Udaipur due to wide circulation of the video.
