The Madras High Court’s Public Prosecutor R Rajarathinam and Government Pleader MK Subramanian today tendered their resignations, citing personal reasons..Additional Public Prosecutor C Emilias has been appointed as Public Prosecutor in charge, whereas Special Government Pleader TN Rajagopalan has been appointed Government Pleader in charge for the time being..Speaking to Bar & Bench, Advocate General Vijay Narayan has confirmed the same. These are not regular appointments which require the consultation with the High Court as per Section 24 of the CrPC..Rajarathinam and Subramian were appointees of the erswthile J Jayalalithaa-led AIADMK regime..The resignation of the two law officers comes at a time when political tensions are high and making their presence felt in the High Court. Cases that are likely to determine whether the incumbent AIADMK-led state government will remain or fall are currently progressing in Court..The challenge to the recent disqualification of 18 rebel AIADMK MLAs from the legislative assembly will continue to be heard on October 9 before Justice K Ravichandrababu..When the matter was heard yesterday, the Court saw it fit to allow the interim orders passed earlier to continue. The interim order passed by Justice M Duraiswamy had stayed a proposed Floor Test of the ruling government and restrained elections in respect of the seats of the 18 disqualified MLAs until further orders..Integrally connected matters concerning the demand for a Floor Test, disqualification of deputy CM O Paneerselvam (‘OPS’) and 10 other AIADMK MLAs, as well as the challenge to a privilege committee notice issued to opposition leader MK Stalin and 21 other DMK MLAs are likely to be heard in the coming week..It was only recently that the OPS faction of the AIADMK merged with the ruling AIADMK faction led by current Chief Minister E Palaniswami. The merger commenced with the appointment of OPS as the Deputy Chief Minister for the state.
