Chief Justice of the High Court of Jammu & Kashmir and Ladakh N Kotiswar Singh recently impressed upon judges to write verdicts that can be understood by litigants..He said,"It is the duty of a judge to write judgments understandable by a litigant and not for the higher courts. The judgment should be clear, lucid and with good reasoning. For a good judgment, the facts of the case should be properly marshalled and the law should be applied with clear reasons for accepting or rejecting any claim of the litigant.".The judge was speaking at a one-day interactive program on order/judgment writing organised by the Jammu & Kashmir Judicial Academy on Thursday.The program was inaugrated by the Chief Justice and attended by Justice Sindhu Sharma, who is Chairperson of the Jammu & Kashmir Judicial academy, and Justice Javed Iqbal Wani..During his speech, Chief Justice Singh also emphasised that judges are like architectural designers while deciding a case..In her address, Justice Sharma said that the qualities of a judge are to hear courteously, to answer wisely, to consider soberly and to decide impartially."A judge must consider the arguments and claims put forth by the parties while deciding a case and writing a judgment," she emphasised..Justice Wani in his address said that every judgment has to have various basic elements such as statement of material (relevant) facts, legal issues or questions, deliberation to reach at a decision and the ratio or conclusive decision..The day-long program was divided into two technical sessions and an interactive session for feedback.
