The Delhi High court has sought details from the Centre on the steps taken to regulate radio cabs in the capital..In a Public Interest Litigation filed by Advocate Damini Chawla (Petitioner), a Division Bench comprising Chief Justice G Rohini and Justice Rajiv Sahai Endlaw has asked Additional Solicitor General Sanjay Jain to inform the court about the steps taken by the Central government in this regard. Jain had informed the Court that the Centre has taken some steps..“What steps you have taken with regard to the issue. How you are proceeding with the matter, inform us,” the court said, adding, “We will keep it (PIL) pending.”.Damini, in her petition, has claimed that many tax/ cab operators, which are internet or telephonic based, are operating in violation of the Radio taxi Scheme, 2006 formulated by the Delhi government..As per the petition,.“..in recent times, a number of internet based companies providing services for online/ telephonic booking of cab(s)/ taxi(s)/ rented car(s) have surfaced viz. ‘Uber cabs’, ‘Ola Cabs’, ‘Taxi for Sure’, ‘Meru cabs’etc. Such car rental companies only provide for a platform/ interface for booking cabs. Surprisingly, it has come to the knowledge of the Petitioner that the said companies neither own any car(s) nor they have permanently employed drivers on their payroll. On the contrary, the said companies only divert the passengers’ request to an independent/ third party car owner(s) and driver(s). The said acts are blatant violation of the Radio Taxi Scheme, 2006 formulated by Department of Transport, Government of NCT Delhi.”.The Petitioner has also submitted that web-based car companies circumvent laws and rules under the garb of being only a provider of a web portal/ interface for booking of taxis claiming that they do not fall under the purview of the guidelines made by the Transport Department..Damini has also recounted her experience when she availed the services of Ola cabs on November 13, 2014 and was taken aback when the driver of the cab told her that he was an accused in a murder case and was out on bail..Damini has, therefore, prayed for a ban on web and mobile based car companies which are not adhering to the law regulating the business of renting motor cabs. She has also sought formulation of guidelines to regulate the business of web/ mobile based cab renting..The Court after directing the Centre to submit details regarding the actions taken by it fixed the matter for further hearing on February 4, 2015.
