One of the reasons for the huge backlog of cases in the Supreme Court is frequent adjournments sought by lawyers, Justice MR Shah said on Tuesday. .The issue of pendency of cases came up for discussion during the hearing of a case relating to ban on manufacturer and use of firecrackers across India."One of the reasons for pendency is letter for adjournments. Everyday 5 to 6 matters in criminal matters adjournments letters are given, where personal difficulty is cited," Justice Shah said.The remarks were made during the discussion on when the case has to be listed for final disposal.When the matter was taken up for hearing Justice Shah asked parties when it should be listed for final hearing. Senior Counsel Gopal Sankaranarayanan appearing for the petitioners submitted that they are ready. "The lawyers have to decide," the Bench said."We are virtually overburdened. Everyday some or other counsel ask us to take their matters," Justice Shah added. Senior Advocate Dushyant Dave then highlighted that the backlog in Supreme Court is on the rise. "There are 70,000 pending cases in this court," he said. Justice Shah then said that adjournment by lawyers is one of the reasons for the same. "We dont want to work for certificate from others. We are asking juniors to argue but they do not. We are saying give 5 percent discount if junior argue," Justice Shah remarked."Then we will have to surrender our gowns," said Dave in lighter vein. .The Court eventually proceeded to list the case on July 22.
