The Gujarat High Court on Wednesday frowned upon the practice of lawyers filing voluminous case records without an index..A Bench of Chief Justice Sunita Agarwal and Justice Aniruddha P Mayee orally observed,“You people don’t give any index. It is so difficult to find any paper in any compilation. It wastes such precious time of the court…this is a routine manner, not just your case. Everyone, every matter…everyone is doing the same thing. You are filing any bulky records without any index…there has to be a master index! Where is the index?...I have not come across a single file where there was an index." For the last eight months, the Court has not seen a single case record where there was an index, added CJ Agarwal..The Court made the remark while hearing a power of attorney (LPA) matter. The counsel pointed out that usually, such matters don't include an index. To this, the Chief Justice replied,“Don’t tell me normally. What normally? Normally you don’t give index?”She then passed the file to the lawyer and asked him to find the page he was referring to. However, the counsel sought time to argue the matter. The Court scheduled the hearing for May 1, emphasising that it would not be postponed further, as it was 10 years old.
