The New Delhi Municipal Council (NDMC) told the Delhi High Court on Saturday that nothing is going to happen to Delhi’s Sunehri Bagh Masjid anytime soon. .Advocate Sriharsha Peechara appeared for the NDMC and stated at present, NDMC has merely issued a public notice and invited suggestions but no decision can be taken until the views of the Heritage Conservation Committee (HCC) is taken. The HCC is to be reconstituted since some of its members have resigned. Nothing is going to happen anytime soon. The notice issued by us is only procedural, Peechara said..The submission was made while a vacation bench of Justice Manoj Jain was hearing the plea filed by Abdul Aziz, imam of the Sunehri Bagh Masjid challenging the NDMC’s public notice issued on December 24, 2023.During the hearing, the Court also questioned the locus of the Imam to approach the High Court when the property rests with the Delhi Waqf Board. The Court, after hearing brief arguments, adjourned the case to January 8..NDMC had asked the general public to give objections/suggestions regarding removal of Sunehri Bagh Masjid due to alleged traffic congestion in the area.In his plea, Aziz has argued that Sunehri Bagh Masjid is more than 150-year-old and the NDMC’s claim that it causes traffic in the area is wrong.“The Mosque is a symbol of rich cultural heritage of the country and till date five times namaz is being offered in a regulated manner during VVIP movement. The existence of Heritage Building/Sunehri Bagh Masjid has never been a problem of any nature/orientation or magnitude rather a reference to collective growth and development of the Lutyens,” the plea stated. It contended that the entire Lutyens area came into existence and settled around the Masjid decades after it was built and no disturbance was caused either to the mosque of the surrounding area.“Surprisingly the Mosque which is a symbol of cultural legacy travelled through centuries till date to blend aesthetically in its surrounding become victim of fallacious theory of alleged traffic congestion by the Respondents.”
