A Bench of Justices Sanjay Kishan Kaul and MM Sundresh also held that for Section 34 to be attracted there has to be concrete proof of common intention.

Mere statement or common intention for a criminal action will not attract the offence under Section 34 of the Indian Penal Code unless there is an act in furtherance of such intention, the Supreme Court ruled [Japreet Singh @ Jassu v State of Punjab].
