A Delhi Court today stayed the proceedings in the criminal defamation case filed by TMC MP Mahua Moitra against Zee News Editor-in-Chief Sudhir Chaudhary. .The order was passed by Additional Sessions Judge Rakesh Syal in a revision petition preferred by Sudhir Chaudhary..Mahua Moitra had filed the criminal defamation case against Chaudhary after he alleged that Moitra’s June 25 speech in Parliament on the ‘Seven Signs of Fascism’, was plagiarized..In her pre-summoning statement before the Court, Moitra had called the allegations of plagiarism false, baseless and malicious. Moitra asserted that in her speech, she “specifically mentioned and attributed” that the signs were taken from a longer list of signs available on a poster in the Holocaust Museum in the USA..She deposed that Sudhir Chaudhary’s allegation that she had copied the work of one Martin Longman was intended to severely and irreversibly damage and lower her credibility, reputation and impeccable integrity..Moitra alleged that in his evening prime time show, DNA, which is aired all over India, Chaudhary personally attacked her for the speech and made “defamatory imputations and comments” against her, both in her personal and professional capacity..Meanwhile, Chaudhary also moved the Court by filing an application under Section 340 CrPC to initiate criminal action against Moitra for filing a false criminal defamation case and “playing fraud” with the Court. This case is currently pending..After concluding the pre-summoning in the defamation case, Metropolitan Magistrate Preeti Parewa had posted the case for orders on the issue of summons..Before the Sessions Court, Chaudhary raised objections on the ground that the Metropolitan Magistrate proceeded with the defamation case without hearing the application under Section 340 CrPC..After hearing the counsel at length, the Additional Sessions Court stayed the proceedings before the Metropolitan Magistrate..Sudhir Chaudhary was represented by Advocate Vijay Aggarwal..The matter will be next heard on October 18..Read the order:
