Madras High Court quashes POCSO charges, child marriage case against man citing plight of children born from the union

If the POCSO Act and the Prohibition of Child Marriage Act are mechanically applied, the minor children will have “to face cruelty of the society” for no fault of their own, the Court said.

The Madurai bench of the Madras High Court recently quashed a case against a man charged with offences under the Protection of Children from Sexual Offences Act (POCSO Act) after noting that the victim was his wife whom he had married while she was a minor and that the children born out of the wedlock would suffer if the accused were sent to jail.
