He had been in judicial custody since December 27, 2023..According to the prosecution, one Chandra Mohan Yadav had informed the police that the accused Damodar Yadavand others had a dispute with his cousin Radheshyam Yadav.On November 2, 2023, Radheshyam posted a video on Facebook in which he was seen consuming poison and alleging that Damodar Yadav would be responsible for his death. Radheshyam was admitted to the hospital but passed away on the same day. Subsequently, a case was registered against Damodar Yadav and others under Section 306 (abetment of suicide) of the Indian Penal Code (IPC). The accused was arrested on December 27, 2023 and the final report was submitted on December 28, 2023..The counsel for the applicant argued that he never intended to cause the death of Radheshyam and that even if the entire allegations are taken at face value, no offence of abetment or instigation is made out against him.Mere harassment or abuse will not amount to instigation or abetment of suicide, it was argued.He added that the trial court had granted bail to the other co-accused and since the applicant is a farmer and has family responsibilities, he was not a flight risk. .The State counsel opposed the bail plea.After considering the arguments from both parties and evaluating the overall circumstances of the case, the Court proceeded to grant bail to the accused."Accordingly, it is directed that applicant Damodar Yadav shall be released on bail in connection with Crime No.455 of 2023 registered at Police Station Dharnavada, District Guna (M.P.) for offence punishable under Section 306 read with Section 34 of IPC upon furnishing a personal bond in the sum of Rs.50,000/- (Rupees fifty thousand only) with one surety of the same amount to the satisfaction of the Trial Court," the Court directed.The petitioner was represented by advocate Siddharth Sijoria.The State was represented by advocate VPS Tomar..[Read Order]
